Are Bad-Credit Loans Illegal in New Zealand?

"Bad-credit loan" is a marketing description, not a separate legal category of loan.
New Zealand law does not create a blanket rule making every loan to a person with bad credit illegal. However, lenders must comply with the Credit Contracts and Consumer Finance Act 2003 and the lender responsibility principles.
Before entering a consumer credit agreement, a lender must make reasonable inquiries and be satisfied that:
  • The loan is likely to meet the borrower's requirements and objectives
  • The borrower is likely to make the repayments without suffering substantial hardship
  • The borrower can make an informed decision and understand the agreement's implications
Lenders must also comply with disclosure, advertising, fee, security, hardship, and fair-treatment obligations.
Advertising cannot suggest that the lender will ignore a person's circumstances. The Responsible Lending Code identifies claims such as "bad credit history - OK" and "bankrupt - OK" as prohibited advertising practices.
High-cost loans are also subject to additional legal restrictions, including limits on interest, fees, repeat borrowing, and the total cost of borrowing.
So the accurate message is:

Bad-credit lending is not automatically lawful merely because a lender is willing to provide it. Every loan and every advertisement must comply with New Zealand consumer-credit law.

Why Alternate Finance Does Not Offer Bad-Credit Loans

Alternate Finance does not approve a loan simply because an applicant can provide security or is willing to pay a higher rate.
Our standard lending process includes a credit check and an assessment of the applicant's current circumstances. We consider the loan's purpose, the amount requested, income, essential expenses, existing financial commitments, repayment history, and any proposed security.
If an applicant's credit history does not meet our lending criteria, we do not offer a special bad-credit product as a workaround.
Security does not make an unaffordable loan affordable. A vehicle, property, or other permitted asset may reduce a lender's loss if an agreement is not met, but it does not remove the lender's duty to assess suitability and affordability.

What Does "Bad Credit" Mean?

"Bad credit" usually means that information in a credit report suggests a higher risk of future repayment problems.
A credit report may include:
  • Current and previous credit accounts
  • Repayment history
  • Missed payments
  • Defaults
  • Previous applications or credit enquiries
  • Debt-collection information
  • Insolvency information
New Zealand has three main credit reporting companies: Centrix, Equifax, and Experian. They may hold different information and use different scoring models. A lender may also use its own assessment criteria.
A low score does not always mean the information is accurate. It can also result from an error, identity fraud, or a limited credit history.

Check Your Credit Reports Before Doing Anything Else

Request your credit information from all three New Zealand credit reporters:
Check:
  • Whether every account belongs to you
  • Whether balances and account statuses appear correct
  • Whether paid defaults have been updated
  • Whether any enquiries are unfamiliar
  • Whether old addresses or identity details are incorrect
If something is wrong, contact the credit reporter and request a correction. Credit reporters must take reasonable steps to ensure the information they hold is accurate and respond to correction requests.
If you suspect identity fraud, ask about suppressing or freezing your credit information.

Avoid Making Repeated Loan Applications

A formal loan application will usually involve a credit check. The resulting enquiry may be recorded on your credit file.
Several applications within a short period can make it appear that you are urgently seeking credit or trying to obtain more borrowing than you can afford.
If a lender declines an application:
  1. Pause before applying somewhere else.
  2. Ask whether the lender can explain the main reason.
  3. Check all three credit reports for errors.
  4. Review your income, expenses, and existing debts.
  5. Seek independent help before taking on higher-cost credit.
Do not pay an upfront fee to anyone promising to remove accurate defaults or guarantee loan approval.

Can Debt Consolidation Fix Bad Credit?

Debt consolidation combines selected debts into one new credit agreement. It may simplify repayments in some circumstances, but it is not an instant credit repair.
Accurate defaults and previous enquiries can remain on a credit report after a debt is repaid. A report should be updated to show that a debt or default has been paid, but the history does not necessarily disappear.
Consolidation can also introduce new costs or risks. For example:
  • A longer term can reduce each repayment but increase the total cost
  • Establishment and administration fees may apply
  • Unsecured debts could become secured against an asset
  • Reusing cleared credit facilities could leave a person with more debt
Alternate Finance does not offer debt consolidation as a way to bypass unacceptable credit history. Any standard application must meet our lending criteria and responsible-lending assessment.

What Can You Do Instead of Applying for Another Loan?

Speak With Your Existing Lender

If you are struggling with repayments, contact the lender early. It may be possible to agree on a different repayment arrangement or, if you meet the legal requirements, apply for a hardship variation.

Check Work and Income Assistance

Depending on the expense and your circumstances, Work and Income may offer a grant, recoverable assistance, or another form of support. Check eligibility directly rather than assuming a commercial loan is the only option.

Investigate Lower-Cost Community Finance

Some people may qualify for low-cost or no-interest community lending. Eligibility and availability vary. A financial mentor can help identify appropriate services.

There is no legitimate instant fix. Steps that may help include:

  • Correcting inaccurate credit-report information
  • Reducing revolving debt where the budget allows
  • Avoiding unnecessary credit applications
  • Closing unused facilities where appropriate after considering the effect on your finances
  • Keeping contact details current with lenders and service providers
Be cautious of any business promising to create a clean credit record quickly. Accurate negative information may remain for the reporting period allowed by law.

Your Rights When Borrowing

A lender must help you make an informed decision and provide important information in writing before you enter an agreement.

  • The repayment schedule
  • The total amount payable
  • Any asset used as security
  • Default consequences

  • The complaints process
The lender must treat borrowers reasonably and ethically, including when repayment problems arise.
